Leonis Martinez and Davide Bonfatti are here and it looks like his brother Jaden is over there.
student special interest Julian likes to play soccer and games enjoys helping
others and is part of the Smalls Elementary Safety Patrol committee
Julian loves watching movies with his family as well as going shopping
favorite subject is math because he likes it and he's good at it from his
fourth grade teacher ela are Tiana Escobar Julian is an amazing shark in
class he's dependable he's a dependable student who is always ready to help his
classmates he's also gets very eager to share his thoughts on things we do in
in class such as discussing book themes or sharing his poetry it's a joy to have
him in class from fourth grade math and science teacher Laura Johanson Julian is
an enthusiastic learner and never misses an opportunity to help a classmate and
from principal Charlotte Gilter his spirit heart and commitment to serve
around our school does not go unnoticed he's truly living up to our campus motto

Good evening, President Greg Schulte, board members, and Superintendent Gregorski.
My name is Julian Bonfatti, and I am a fourth-grader student at Schmalz Elementary,
where I am currently involved with our student council.
My first year to attend Schmalz was in the second grade.
I have had great teachers, especially Ms. Henkel, Ms. Orsak, Ms. Nelly, Ms. Johansen, Ms. Escobar, Ms. Abbey.
They are my favorite teachers because they took me to an advanced level of learning and taught me so much.
Although I have only been at Schmalz for two years, some of my best memories and favorite events have been the character parade, the Christmas party, and the council celebration.
I've also appreciated playing games with my friends in the first day of school each year.
I am honored to have had the privilege of joining you this evening to lead the Pledge of Allegiance. Thank you.

This time I'd like to introduce Maria DiPetta, manager of media relations, for the recognitions
portion of our meeting.
Good evening, President Cholte, trustees, and Superintendent Gregorski.
This evening we begin with the Association for Learning Environments Award Program, which
which recognizes outstanding educational facilities in the southern region, which positively impact
teaching and learning, and result from the sound planning process that reflects the needs
and expectations of the community.
At this time, I'd like to introduce Jennifer Henriksen and Perol Villas from Stantec to
present the summit award on behalf of the Association for Learning Environments, as
well as Executive Director Lisa Kastman.
On behalf of the District and as President of the Gulf Coast Chapter, the President of
the Southern Region couldn't be here, but he sent some words.
Let me start by offering my apologies for not being able to attend this meeting in person.
A4LE has eight regions representing 44 chapters incorporating every U.S. state and 37 countries.
Of these regions, the southern region is the largest numerically with over 1,700 members.
The summit award is presented annually to recognize outstanding educational facilities
in the southern region, Texas, Louisiana, Arkansas, and Oklahoma.
The points are awarded to the project based on the following criteria, school and community
research and or engagement, educational environmental design, physical environmental design, results
of the process and project, sustainability, and wellness.

explore the natural environment beautiful synergy between existing
buildings landscaping and the new building respect for history of the site

President Schulte, Superintendent Grigorski and Board, it's our distinct honor to introduce
the newest KDISD officer to y'all tonight.
Officer Kiana Braxton was born April 11, 1997 to Ron Braxton and her late mother, Deborah
Braxton.
She was born and raised in Houston, Texas and graduated in 2015 from Dikani High School
in spring ISD.
In 2020, she received her Bachelor of Science in Criminal Justice from Sam Houston State University.
Kiana decided to attend the Criminal Justice Training Center at the University of Houston downtown
to receive her basic peace officer certification in 2021.
We feel, and in this profession, the thin blue line represents family.
It could not be truer in this case.
Her father Ron is a detective with the South Houston Police Department with over 30 years of law enforcement experience.
Her brother Delvin is also a detective with the Harris County Sheriff's Department.
And the thing she left out of here is that Ron also used to work for the city of Katy a long time ago.
At this time I'd like to invite Ron and Delvin to come up here along with Kiana.

I was planning on coming in today to read from yet another inappropriate book
that is from our school's physical library catalog.
While I was preparing remarks for that, I decided against it,
and the reason why is because there's already been a mountain of evidence
given to this Board of Trustees time and again.
You guys have seen the sexually explicit, graphic,
and wildly inappropriate material that is deemed as educational
in our district's libraries.
You don't need me to read from another book to prove to you
what is being masqueraded as appropriate or substantive reading material.
What I want to know is what is the district doing in response?
Where is the admittance of negligence on the district's part?
and the recourse to write the gross oversight.
Beyond that, I find it somewhat poetic that this meeting should fall on the day that early voting begins,
and two of your board seats are being fought over,
the result of which may be in direct relation to what parents feel is due to that said negligence in multiple areas.
I noticed on your agenda tonight that this evening that there is going to be space for discussion on curriculum,
on human sexuality instruction. This brings up more questions that it seems
we already have slight answers to, such as what is the district's approach to
basic human biology and sexuality? Does the district believe and instruct
students about what defines a woman and a man? Or are those open-ended terms in
KDISD's site to be decided upon by young adults or in some cases elementary
school children with pre-developed frontal lobes? A recent survey stated
that this was distributed among KDISD students gave them options about gender
and identification as are we as parents to take this as another subversive step
by the district and to political ideology based on the winds of the
cultural climate you recently held a celebration dinner highlighting
exemplary employees of the district once again I find it odd the name of the
event guardians of the district I applaud the hard work and dedication
that our teachers our school bus drivers and our administrative staff give but
you in tandem with parents are supposed to be the guardians of the district
parents are calling for you to get back in step with us the last question I have
for the board is when will you decide to make that corrective step thank you
thank you now we will call the speakers
now we will call the speakers who signed up to speak on non-posted agenda items
by policy a maximum of 30 minutes has been allocated with the time divided equally amongst
those who have signed up each speaker will have approximately two two minutes and 43 seconds to
speak. I do want to issue a warning that I've been and I appreciate the speakers
letting me know but several speakers have indicated that they're going to
read obscene material and if there's children present in the in the in the
audience you may want to consider removing your children from the from the
quorum here tonight. And with that we'll go to the speakers. The first speaker
tonight is Gabrielle Uzu and the second speaker tonight is Heather Tolleson.
When it comes to discussing the literary education of students, it would be optimal to say that
KDISD provides students the opportunity to read and learn from a diverse array of books
representing the many viewpoints and lives contained not only in the KD community, but
in the world at large as well.
That is an ideal that KDISD sadly hasn't reached.
Let's think back to the incident involving author Jerry Kraft earlier this year, where
where one of his graphic novels, New Kid, was taken off KISD shelves for review.
I've talked to a young black boy who recounted his concern after having this book taken away from him
after he checked it out because the message spoke to his own personal experiences with race.
Why did KISD deprive kids access to this book for a 10-day review period?
Simply because parents complained about it supposedly teaching CRT, critical race theory,
which it is not, seeing this volubly affirming book as a threat.
After more parents got involved in the issue and voiced their concerns about the banning of New Kid,
KISD recanted their suspension of Jerry Kraft's authorial visit and reinstated books on shelves.
Seemingly no harm was done. But why did it take such an emotional roller coaster
for nothing to happen? I discuss this not to open up old runes, but to remind everyone that KISD has
a history of making confusing and contradictory decisions at the behest of parents, who can often
be a loud minority shouting over the more moderate demographics and students within the school
district. District policy is too vague and thus too exploitable in its current form. If a parent
can report mouse for pornographic content simply for a cartoon illustration of a mouse without
clothes and have this report garner such an immense reaction on the part of KISD, it is
incredibly apparent that the process in which KISD fetters through these parental complaints
is disorganized and predisposed to discrimination, either accidental or intentional. The reason why
I say that these policies give way to discrimination is because it can be found that queer BIPOC stories
are held to a much more discriminatory standard than heterosexual cisgender raceless media.
While Cinderella is Dead is being targeted for pornographic content, numerous YA fantasy novels that are being distributed by KISD libraries are given a pass.
This is because queer stories in particular are automatically seen as more lewd and pervasive, even with the same amount of explicit content as other media.
When KISD leaves it up to the parents what should be taken out, those who discriminate against queer BIPOC stories with this double standard exploit the disorganized system to target valuably affirming stories.
These books aren't meant to indoctrinate or to corrupt children with the stories they tell.
They are meant to provide those without a voice an opportunity to see that they have value and they are not alone in the struggles they face.
These books should be given more respect and consideration than KIC has given them.
Install more productive review system and hold each and every book to the same standard.

This is my wonderful second grade daughter, a student here in KDISD.
And I just want to say that I hope that one day she is the legacy, not me or anything
I can leave behind or you, but that her and students like her truly can live a full life.
And so I come to speak on behalf of her and with her and for other students who are
still developing their voices and for those courageous students who come here every single
month and speak and speak to you and to those who listen and those who continue to be told
that they're seemingly worth less or shouldn't be allowed to be in libraries or classrooms or have
their voices celebrated and told i think we have it we're just doing a detriment to all of our
students from a very young age to those who are preparing to go into the real world by censoring
anything but especially literature that they can identify with websites that can be life-saving for
those who are struggling to find a place in any kind of love and acceptance in this world
i do everything to teach my children that the fullness of this world is based on all of the
diversity. Everything you bring and everything that we bring here, no matter how different we
are, we can only know the fullness of life by embracing anyone who is different than us and
those who are just like us. So continue to fight for students' rights. Continue to put them first.
Continue to celebrate those things that make us uncomfortable, those things we might not identify
identify with, those things that we might even disagree with.
We can't understand other people in this world without hearing their stories.
Don't take books off the shelves.
Enable parents to do their jobs in helping their kids decide what to read and allow those
who deeply want to find a place to find their place to be heard, to be celebrated, and to
to create a legacy for the future.

The quality or state of showing poor taste or manners,
That is the definition of what was labeled as the books that were perceived as vulgar.
Stories that speak about the poor experience of their identity showing its true colors and being told that human decency isn't what they are worth.
Sentences that paint a realistic portrait of how historical events occurred with no censorship because what would be the point of sugarcoating history if that's not what actually happened?
words that plea for acceptance even though they didn't have a choice to be born a certain shape, color, pattern, or behavior the world around them has perceived was normal, therefore the law in their perspective.
Do not manipulate a form of attraction that you don't accept as a way of it away as inappropriate behavior.
Do not invalidate a human being's identity as a threat to your children.
Do not call a minor a pedophile.
Do not call a personality a new term brought into this new culture.
That is not the censorship and leadership the future generation deserves.
We deserve to be shown what real humanity is.
And that is what are in those books that are ripped off the shelves and away from kids in need of experience
Acceptance and real humanity. We are not a term. We are people just like you

Tonight, I want to speak about the protection of all children, your most important asset,
and the ongoing negligence by this Board of Trustees and the district regarding the grooming
and hyper-sexualization of students and the pornographic material that remains on library
shelves.
You have known about this problem since September of 2021.
The onus should not be on the parent to find the books one by one.
You were voted into your position to represent and advocate on the behalf of all students and taxpayers,
but you act as though you were appointed by the district.
We didn't elect you just to listen. You need to act.
No one needs in name only rubber stamper seat warmer board members.
This is a waste of everyone's time and tax dollars.
Each of you board members should have had an active role in overseeing an immediate thorough audit of all library books
and stopping the distribution of harmful material to minors.
Federal and state laws that prohibit the distribution of pornography or harmful material to minors are being broken.
If you've actually done something other than just listen, then you're not being transparent about it or not communicating it well.
And frankly, it's not enough.
To repeat, the current process is broken.
Last week, I formally challenged this book, Looking for Alaska.
It was in six junior highs and 11 high school campuses.
A child as young as 11 years old could have read what I'm about to read.
It's been approved by the district to remain in all 11 high schools.
We found plenty of porn magazines, the bitches of Madison County.
We ran with it to the TV room, closed the blinds, locked the door and watched the movie.
It opened with a woman standing on a bridge with her legs spread while a guy knelt in
front of her giving her oral sex.
This just doesn't make sex look fun for women.
This girl is just an object.
A woman crouched on her hands and knees while a guy knelt behind her.
She kept saying, give it to me and moaning, her eyes brown and blank.
She said, never do it that hard.
That would hurt.
That looks like torture.
All she can do is just sit there and take it.
Given their position, I don't think they can kiss right now, I noted.
That's my point.
Just by virtue of how they're doing it, it's objectification.
He can't even see her face.
The district process has approved this harmful pornographic material to be shared with minors
You are not protecting our children. I hope the public considers this

Good evening
Thank you. Thank you for your time. I would like to speak about the new TA model, the
school board policy for purchasing and removal of library materials, which addresses obscene
content. I expect the board is in the process of considering it, and I urge you to do so,
and we eagerly await your review. I am confident this model policy came about as a result of
concerned parents speaking out across the state and also here in Katy. Our mutual goal
goal should be to avoid the early sexualization of our children and
protect them from harmful materials and from pervasively vulgar materials. What I
really like is a new guidelines focus on maximum transparency with parents and
community members. The policy recognizes that parents hold an essential role in
the education of their children and have the right to guide what their children
read. The policy placed the legal responsibility for the purchase of
library materials squarely on the board the board provides final approval for
all new library materials per the proposed policy the board has a 30-day
review period after has been proposed by the superintendent they are to be
included in board agendas more importantly the district shall make the
selection process of library materials readily available for parental review
with a list posted online per the policy as proposed parents will have a 10-day
parent pre-review period prior to a book being placed on the shelves.
The model policy also provides a more transparent process for a challenge to a book already
in the libraries.
The major criteria for the final decision on challenge library materials is the appropriateness
of the resource for its intended educational use.
No challenge instructional material shall be removed solely because of ideas it expresses,
but allows the removal of materials because they are pervasively vulgar or
based on educational suitability. Also in determining the
appropriateness, it shall include a review of and compliance with the Texas
Penal Code. The Texas Penal Code describes harmful material as material
whose dominant theme taken as a whole appeals to the apparent interest of a
minor in sex, nudity, or excretion, is patently offensive to prevailing
standards in the adult community when taking as a whole with respect to what
is suitable for minors and is utterly without redeeming social value to
minors. Besides these factors of making determination the TEA reminds us
that for Texas Penal Code it is an offense to distribute or exhibit
material shown to be harmfully material to minor. I finally just want to
emphasize as you review this policy raise our standards let's let's be the
the standard. Let's protect the children. Let's let our children be children. And remember,
our students are our parents first, children first.

My name is Valerie Reynolds, resident of Cross Creek, KDISD.
Has been brought to my attention that some students are distributing free booklet on
gender identity in KDISD high schools.
And being questioned by parents, KDISD admitted that it has been approved to distribute these
materials to the students without disclosing the content of these books or obtaining approval
from parents in advance.
I'm shocked and upset about the fact that parents were not involved in this process.
It is a violation of our rights as legal guardians and parents of our children, minors, in legal
perspective.
By this statement, I demand respect and protection on our rights as legal guardians of our children
from KDISD.
that all materials other than core curriculum needs to be fully disclosed to parents and
parental approval needs to be obtained before exposing students to such materials.
The materials increase but not limited to the reading, any reading material, content
the teachers are teaching, content of school counselor are consulting with students with.

Good morning. I'm here for calling everyone in this room and paying attention to our children's mental and psychological development.
There is a PTA volunteer who has a position as a fundraiser in our children's school.
school and she was intended to disturb the live performance with slapping the children's
instrument and she is a 10 years old girl.
So you can imagine how shocked parents they are when this happened.
So the parents, we reached out to the principal, the KITISD PTA, including the school's PTA, to ask them how to solve this problem because this hurt the children's emotion.
Unfortunately, we didn't get the clear reaction so far.
and this lady and she will become the PTA president in 2022 to 2023.
So we, as a parent, we started to think about why those cannot get too much attention when this happened.
If this happened like a physical attack, we believe the principal, including the other
organization, they will solve this problem quickly.
Because the psychological issue or abuse children emotionally, mentally, that is invisible.
visible, but that is existing.
I see many kids, they were ignored in school,
but the parents, they didn't aware of that.
If there is a scrub on the body, the kids get home.
Parents can see that at once.
But for the psychological problem
that happened on our children we cannot see and the consequences cannot come up
come up at once maybe in month in years but we are sure.

As for myself, I feel honored to be in front of a rich organization in my area of being gay.

Your websites say you are.
I am only curious to know who brought you here or what brought you here.
If you're not representing my rights, are you here to dox me and label the parents as everything that ends with a foe?
My love for God and protecting his kids will make me guilty.

I take you back to November 2020.
In a direct assault on public trust,
your GC weaponized his authority
and concocted an unethical conspiracy.
What I will tell you today should scare the daylights
out of every single parent of school-age kids.
In disturbing quid pro quo fashion,
the GC devised a scheme to obtain the results he needed and as a reward he
agreed to send and direct future school business to a private lab in exchange
for their cooperation in his targeted effort against Bronson. The day before
the deadline we had set for KDISD to resolve the 2019 false statement issue,
KDISD in what now looks like a non-random search search Bronson's
vehicle on campus three officers with their body cameras turned on found
nothing the fourth officer who just showed up and who conveniently had his
body camera turned off searched the vehicle and allegedly found 0.04 grams
of a green leafy substance the size of a small peppercorn.
Against KDISD policy, the green substance was sent via FedEx
to a private lab in Arlington, Texas for testing.
This was the first time KDISD had used this lab.
Normally, samples are hand-delivered to a government lab
such as DPS or Harris County.
Why not this time?
I will answer that because the amount was so tiny that it did not meet government standards to ensure
thorough testing
We asked for our half of the sample to conduct our own testing
But JC refused we also told the GC
We want it to be present for their testing of the substance, but the GC proceeded
Without us and in doing so the GC knowingly
destroyed the evidence being used against Bronson.
Why would a school district lawyer behave this way?
Justice, guys.

A court hearing for Bronson was fast approaching on November 20, 2020, and the GC knew his evidence was weak.
The GC put his conspiracy into action.
In emails we have obtained, unbeknownst to the GC, I have proof of his quid pro quo.
In emails referencing the lab from November the 17th, 2020, GC says to Chief Gall, quote,
Henry, I think the superintendent may go for this.
He and I are talking today.
GC asks Gall, quote, who is your contact there?
I would like to speak with him to make a deal.
Two days later, November the 19th, 2020, GC asks Gall, quote, so they will have it tomorrow?
This is very high priority for us.
If they can come through for us on this request, they will get a lot of business from us.
So come through for us on this one and you and I can direct more school district clients to them.
This is so slimy and unethical and to do this to a student, if this isn't a smoking gun and an abuse of power,
I don't know what is. In writing, your general counsel implicated the superintendent and the chief of police and he
negotiated sending future business cash flow to a private lab if they would produce the lab results
he needed to save face and protect his job.
Apparently, realizing the horrific optics of his conduct and knowing the Board of Trustees and the public would view his behavior,
your General Counsel intentionally failed to produce these exact emails to us in the court-required discovery process.
As part of the agreement to dismiss the lab from the lawsuit, the lab provided these emails to us and their production of discovery.
Apparently, the General Counsel thought he had hid these emails well, never expecting them to land in my hands or in front of this Board.
board. I ask board members, you stand for this unethical behavior? This is the type of lawyer
you won't represent in KDISD? At a minimum, this board should place the general counsel on leave
and have TEA and the state bar investigate his conduct, pending the results at the very least,
redefine his job duties, and for God's sake, keep him away from our students. After these new
revelations today, and there are more, you should have a clear view of why the superintendent and
the general counsel are refusing to give their depositions. As elected members of the board,
your credibility is undermined when you turn a blind eye toward this type of conduct. The community
is watching. Demand transparency and hold guilty parties to the same standards you hold our
students within KDISD. There should be no hypocrisy. When we sit before the national news media and tell
this entire story, perhaps reality will then awaken you. This has all occurred at the hands of the
general counsel who proclaimed, quote, I don't give a about that kid. Well, Mr. General Counsel, you're
not dealing with that kid anymore you're dealing with the lord and his mighty word and i remind
you of numbers 32 23 quote be sure your sin will find you out thank you the next speaker

good evening board thank you for allowing me to speak tonight my name is angie waller and i have
have a senior here in KDISD and two that have already graduated.
I've been an active volunteer in the schools in the district every year since we moved here in 2005.
I'm here again tonight to speak about the current policy of reviewing and removing books.
To date, it only takes one parent to file a formal complaint,
and that book is removed immediately pending review.
Then a small committee reviews the book and makes a decision.
In a district with over 90,000 students,
It should take more than just one parent and a handful of people to make a decision about
a book that's being reviewed.
Also you should receive feedback from all the parents in the districts, not just the
handful that are on the committee.
Parents already have a choice of what their own students can read.
They should not be making a choice of what my student can read.
That's my choice, not theirs.
So I propose that a parent has to file a petition along with the review. When they complain about a
book they should also put in a petition stating exactly what is wrong with the book. Not just
getting signatures because anybody can just go collect signatures. They should have to say
exactly what's wrong with this book. Then while the book is being reviewed give all parents a
choice let all parents know what books are being reviewed exactly what's wrong
with the book let all parents have a choice and whether or not that book
should remain in the library or not you've already removed a lot of the
vulgar books that should not be in the library but all of us should have a
choice in this as we've seen from the past few months a parent can find
anything wrong with almost any book take New Kid for example parents had a
problem because I thought I taught critical race theory. My husband lived
that life so no it's not critical race theory. It's true. Having a single
individual dictating book availability for all students in KDISD even
temporary is antithetical to the principles of free speech and allowing
parents to have a say in their children's education. Our children and
the parents of KDISD should not be subjected that kind of minority rule so
So it's time to update this policy and make it actually mean something.

Good evening.
Board of Trustees, you were just presented with a firsthand account of unethical, unprofessional,
and most disturbing conduct by your general counsel.
A few months back, two different board members, volunteers, were investigated and disciplined for alleged unethical conduct, including the allegation they concealed emails and text messages and intentionally failed to provide these documents as was required by the investigation.
Here, in regards to a student, your general counsel has done far worse.
In reckless fashion and with complete disregard for the truth, through his own self-contrived plan, he intentionally acted with gross misconduct that could likely be labeled as bribery.
Further, just as board members did, the general counsel concealed and failed to turn over his own harmful emails that was required by the court in the discovery process.
In doing so, the General Counsel violated the rules of civil procedure and hid the emails from the District Attorney and the McClellan family.
The General Counsel has intentionally violated KDISD policies and most definitely ran afoul of the KDISD mission statement and the rules of the Texas Bar Association.
He is an embarrassment to the school district.
As Trustee Redmond said a few months ago in this very room, quote, if I was an employee, I would be terminated immediately.

the activities discussed during the year and each of the topics related to one of
the eight focused areas for school health advisory councils received
information on Katie is D nutrition and food service activities and upcoming
wellness policy review, received information on KISD health services including immunizations,
nurse CPR, AED instructor certification, and district COVID testing center. Received information
regarding proclamation 2022 for health and physical education timelines, shack roles,
and responsibilities. Received information on mental health services, resources, and personnel
and KDISD. Received information on Harris County health initiatives and healthy living matters to
target obesity. Received information on resolution from the Board of Trustees required by House Bill
1525 to review and make recommendations regarding human sexuality curriculum materials in accordance

Agenda item 9.2, discuss and consider board approval of the curriculum materials for human sexuality instruction.
As per the 87th legislative session, House Bill 1525 requires the School Health Advisory Council, SHAC,
to make a recommendation to the board regarding curriculum materials that will be used for human sexuality instruction.
The SHAC must hold at least two public meetings on the curriculum materials
materials before making recommendations to present to the board.
Those public meetings were held on February 22nd and March 3rd.
During the meetings, the SHAC committee was provided a comprehensive list of TEKS, including
the human sexuality TEKS, for grades 4 through 12.
The committee also reviewed the instructional materials and parental information provided
for the puberty lessons for grades 4 through 5.
Members reviewed feedback submitted by parents, teachers, and community members collected from November the 15th, 2021 through March 1st, 2022.
The SHAC Committee unanimously voted to recommend the following resources.
elementary health k-5 there was no state approved resource so the committee
recommends continued use of the Procter & Gamble puberty education videos at the
secondary level there was only one state approved resource which was good heart
Wilcox and we are recommending that this resource be used for both junior high

the resources? I don't see the resources. Mr. Grimmett, from your
presentation that you showed what the SHAC had reviewed and had

it's the puberty thing from fourth and fifth grade so what else is in that curriculum so then going
going through for junior high and high school. So you have the anatomy. So that's what we
we normally cover for that. We also talk about healthy relationships. You also talk about
the fertilization process. And like I said, there's a there's a whole list of teaks that
we follow from the state. And I have those and I would be happy to provide those to you.

So it's this is something that parents would be comfortable with because they already see
comfortable or uncomfortable with because it's not something new.

and then at our final health meeting, we probably had, oh, probably roughly 17 or 18 at the very final SHAC meeting.
How were parents notified of these meetings?

So we have to post on all of the high school, that junior high, elementary court boards, if you will.
So that's around the district.
So we post that our meetings are there.
We also share on the Katy Court Board, which is the electronic version of posting out.
We also have our School Health Advisory Council website that parents can access.

We're here this evening to provide you with an update on the Instructional Materials and Technology Allotment
and request your approval of the annual TEKS certification.
To recap the history of the Instructional Materials and the Technology Allotment,
In 2011, Senate Bill 6 was passed to provide flexibility to school districts in the selection of instructional materials, including the purchase of textbooks, supplemental materials, and software.
Our allotment is based on a per-pupil amount and is funded every two years.
It is also important to consider that KDISD curriculum is not driven solely by textbooks.
textbooks. In fact, we use multiple resources, including online resources, literature libraries,
and other hands-on learning tools in our classrooms every day.
This slide depicts our timeline for the selection of materials. We began the process in November
by establishing the review teams consisting of campus staff, parents, and content specialists.
The teams work to review materials and to make recommendations based on need and alignment
to the TEKS and our courses. All proposed instructional materials were displayed here
at the ESC and the public was invited to provide feedback. Physical education and health, which Mr.
Grimmett just went over with you, was the only state proclamation for 2022. In addition, we
identified instructional materials needs in several areas, including career and technical education,
high school science, and high school social studies, as you will see listed on the next two
slides. You also have a detailed list of all recommended materials in your board packet.
It is also important to note that the 2022-23 allotment substantially less than it has been
in previous years. The legislature adjusted the last two proclamations to include pre-K
last year and then health and PE this year, which are much smaller adoptions than your core content.
They also delayed the large core content adoptions, including math and science, which is part of the reason that you'll see the reduction in our funding.
This slide depicts a 63% reduction in the allotment in relation to student growth and inflation.
The legislature did indicate their intention is to increase future allotments to more closely align with the previous allocations, but there is no indication that the current deficit incurred will be offset with increased funding in the next biennium.
Additionally, KDISD did not qualify for a high enrollment growth adjustment.
This chart outlines the planned expenditures for the next year and is broken down by content area.
area. The total estimated expenditures are about $10 million, which will leave a negative
balance of about $6.5 million. Delaying the math and science proclamations did not reduce
the cost that the district will need. We will also need approximately $4.5 million to cover
the cost of these resources until they are reviewed again, and a large part of that is
because we have consumable materials and we have online subscriptions that we still will
need to continue to pay for. We're working with the budget office to identify options to address
the deficit including deferred payments and the use of other funding sources.
This slide shows the upcoming proclamations for the next several years. The next large
adoption will be in the year 2024 for K-12 science. Every school district must certify
annually to the State Board of Education and the Commissioner that students have access to
instructional materials covering all Texas essential knowledge and skills for all required
subjects. In your packet is a copy of the certification document identifying how the
district meets this requirement. You may notice from previous years that TEA has revised the
certification document to be more specific and is broken down by every resource that we utilize
in the core content areas. We're here to address any questions that you may have at this time.

Mr. President, Dr. Caskey, I have one question. So I saw there on the approval,
or explain to me now, the wanting to use ESSER funds to help pay for the deficit that we're
going to be at for this. Was that, it was like a couple slides ago? Yep, that one right there.
Yes, ma'am. So my question at hand is, and it's my only question, because we all know ESSER funds
are only here for a very finite period of time and if we're in a five million dollar or larger deficit six
Something there for your previous slide. How are we going to be accounting for this in future years?
I guess that's my big that's my number one concern and I'm gonna assume yours and
And our CFOs as well. Mr. Smith and mr. Smith have been working on it. They weren't you as well
You want to take that Chris? Yeah in future years the state will allocate the money again
It's just this one-time blip that we're going to be out for this product this this next year
So the state will come that level will presumably rise again until then that's our combination of things that we are options to do
Most likely of which the general funds going to have to offset
Esther funds are you know we know what with what those of our funds are for there weren't really fun basic education
which is what this is.
And so right now the general fund is probably going to have to cover it
or a combination of ESSER funds and general fund.
I would like to do that last bullet on there
and run that fund balance into the red so it could stick out
and we would cover it over time with the general fund.
But accounting rules are probably not going to allow me to do that.
So the general fund is probably going to do it
and we'll be coming to you later this summer
when we determine exactly what we need to do with a budget amendment.

Mr. President, I have a couple of questions, and I'm sorry that we're faced with this,
but first of all, do you know why we didn't get the high enrollment allotment this year?
We did see an enrollment increase last year.
They used what was reported in October of 2020, and we only had a 684 student increase then.
And so if you look at the list of those districts that received it, there were very small districts and a lot of charter schools on that list that received it.
That's the first time.
Nakia can correct me if I'm wrong, that I remember that we haven't been on that list.
Is that correct?
And it was probably because of the slower growth year.
It's all related to COVID.
Okay.
And also, when did we find out about this?
I mean, when did we know that we weren't going to have that high enrollment allotment?
We found out that the last couple of days of January, we weren't going to get that enrollment.
We knew that the state shortened the funding last summer when they adopted all of their budget and stuff.
We knew that they were going to be short and that we were going to be facing this someday.
And I think you did address this, Dr. Caskey, but I just want to make sure I heard it right.
Right. Is there a possibility for us to get paid?
You know, some of it's been delayed.
So to me, delayed means not that it's not going to come.
It means it's delayed.
Deferred payment, correct.
So we possibly might get some of this money back?
No, it's more so that the publishers are going to allow us to make a four-year purchase.
We pay probably for the first two years now, and then 18 months we'll pay for the next two years.

They're just giving us a little more time for those IMA funds to be replenished.
So that they're delayed really isn't really, they're not really delayed.
They're just not going to give it to us.
We're going to be delayed.

But we use instructional materials that expire
and our licenses.

hey, excuse me, we have licenses to renew
new, so the expense is ongoing even though...

We're going to have to extend those online licenses for those materials.
But can we make the State give us the money because we're having the expense, even though
they're delaying it, our expense for instructional materials is ongoing because it's not like
we're going to keep the book for 12 years.
You're exactly right.
If it would even hold together for 12 years.
I think that's part of the fallacy of their decision making, to be honest with you.
And is there a, is there an appeal process?

I will say that today there was a webinar, if you will, and I wasn't able to attend that.
And they were going to run a survey on this, which is essentially what we looked at on the options slide and what other districts were going to do.
because it's this time that everybody's kind of coming to reality that they're not going to have enough money
throughout the budget that was approved last summer, and decisions are starting to be made.
And so there was a survey of how people were going to do that, and I was not able to participate in that webinar.
I'm not seeing the results yet, but I'm sure there will be the same things as what we're doing.
That's what I was thinking is this is this is a problem for districts across the state who who teach in a new way
That's more technology than it is a hardbound book. And so this is gonna be a problem
When people who are not educators make decisions for educators some of these things happen

the presenters miss sherry butterfield director of budget and treasury good evening
good evening president schulte trustees dr gregorski tonight the general operating fund
we're amending state revenues to increase seven million two hundred twenty four thousand one
This is a result of the 2019 property value audit.
Local revenue is also increasing by $42,240,
along with equal and offsetting expenditure increase for the CTE STEM camp.
Expenditures are also increased $147,395
for the setup of new special ed classrooms throughout the district.
and the general operating fund expenditures are increased for the following $2,051,207
for relocation and building a portable decking for 15 campus portables in the district,
$10,000 for MAC fees, and $22,000 for a district-wide efficiency audit.
The remainder of the General Operating Fund expenditure amendments are direct offsets, and the approval of these amendments will result in a $4,993,517 increase to the General Operating Fund.
Food Service Special Revenue Fund has a federal revenue increase of $1,674,717, along with an equal and offsetting expenditure increase due to anticipated funds from the supply chain grant.
Approval of this amendment will result in no change to the Special Revenue Fund balance.
Finally, construction funds are being amended as follows.
$2,414,432 for Elementary 45,
$3,355,213 for Elementary 46,
$2,415,837 for renovations at Katy Elementary,
and $3,407,933 for renovations at Windbourne Elementary.
Funds for these are available within the 2,000 project savings
and within the 2021 bond infrastructure,
resulting in no change to the construction fund balance.

I don't have the figures in front of me and I don't know if Mr. Smith has those, so I don't mean to put them on the spot, but all budget codes or anything have a certain amount of dollars tied to the budget.
And if there's dollars in the budget that cover the cost of that expense of anything that is expensed through that budget, you wouldn't see a budget amendment.

702 is the organization and 702 has
as an administrative expense, 6200s,
where we charge outside legal expenses too.
So we fund 6200 budget every year.
And legal expenses that are done outside of legal services
are charged to that 6200 account.

Sometimes we do cover overages in any one particular area
with other funds, so we'll take money, and you saw it tonight in one of these minutes,
where we take money from travel and put it in instruction or from nursing over into co-curriculars.
When we do that and we need to do an amendment like that, that's when it comes to the board.
But there is money set up in Organization 702, the board's budget,
and that's where outside legal expenses are expensed.

So in general, if somebody wanted to find out how much that cost they would have to do,
I guess a PIR.

But doesn't the PIR cost the district more money?
It doesn't cost additional taxpayer money?
No, we've got a legal team, and within that legal team,
We've got a position that processes our PIRs, any request that comes in.
And so we handle all of that in-house.

And how long does a PIR usually take?
About 10 days to do?

I'd have to ask Mr. Graham, on a PIR request that comes in, you have, what's the legal response time on that?
Well, it would depend on the request in particular, but typically the timeline on our response
is 10 business days or if we can't respond that quickly, we'll let you know within 10
days when that information can be made available.
It would depend.
Sometimes you have to go to the Attorney General for an opinion and again, that's something
that we look at on a case-by-case basis.
But if we already knew the information, like if you knew the information,
someone asked you the information, would you be willing to give the information?

If somebody submitted a PIR request to the district and we had the information,

So if all they asked for was the email where you tell us how much it cost, why would that take 10 days when it's one email?
Or if we're the transparency that we care very much about, we all do, we spent stakeholders' money to do an investigation that we made public.
We made some very difficult things public.
Why wouldn't we just say at this public meeting how much the expenses were?
Why wait for a PIR?
I would say a couple of things.

So in February, we had our debt part of the budget,
and we received approval from this board to sell $215 million worth of bonds.
And I told you the approximate timeline on that was to be September or October
is when we determined we would need that cash.
Since then, or in the last 45 days, these two things have happened.
There have been over 100, I think the last count I heard was 107, that's the one I remember, but it's grown.
But it's been over 100, let's just say, school districts that have called bond elections for May in excess of $15 billion.
And so the thought, and that was one, and the second one is interest rates are going up,
and the yield curve has flattened. So those three things are what this
amendment is about tonight. I am requesting that we move that amount from
215 to 275 million and we're gonna move that sale up not from September or
October but in for the latter part of May to do one of these two things. Take
Take advantage of these low interest rates before they continue to rise.
Take advantage of issuing permanent school fund bonded debt.
In other words, bonds backed by the good faith and
credit of the state of Texas before an abundant supply goes on those in the summertime.
Assuming that a large portion of those school districts bonds pass,
there's gonna be $15 billion in paper out there that's gonna hit the market in June.
And that yield curve is flattening, meaning that we can sell these bonds and invest them in short term and not cost us much.
Before, when that yield curve was sloped, it would cost us more to issue the bonds than we would be able to receive.
But now there is still a cost, but it is flattened and the cost is not near as much.
And so I think it would benefit us to act our financial advisor mostly and I
Think it would benefit us to go ahead and sell the bond sooner rather than later and because of the rates are where they are
And what we think they're going to do we're asking for that amount to go from 215 to 275. But with that said
There is a chance if we if this is approved tonight
we've already got the permanent school fund application approved and are ready
to issue bonds in the next couple of weeks or sell bonds in the next couple
of weeks it's going to take till May the 15th before we can get permanent school
fund approval on this and depending on what the rates do or what we think
they're gonna do we may pull the trigger and do 215 because we won't have
permanent school fund guarantee on the additional amount so that's kind of up
in the air but it all starts to be able to have that ability to go 275 should we
be able to do that I think it would be a good thing financially for the district
to do any questions yes so if we move forward on the 215 would we do a second
tranche for the 60 additional or if we if we pull the trigger on 215 before mid
May we would just stay there we would just stay there at that time unless mr.
Mr. Roberts said, you know, let's do another sale at this date because I still think that we could, if he says, I still think we can benefit from that transaction and getting those rates fixed before the rates move up on us, then yes, we would sell another tranche.
The ideal thing is to be able to just sell it all at once before the
rates move on. Rates have been very choppy. They have gone up since January.
We've seen them going up. We didn't need the money. We still don't, but again with
that flattening of the yield curve, it's not going to cost much at all to
go ahead and get these bonds sold and we can invest the money until we need to
spend it. We still don't anticipate needing to spend it until September-ish.

Tonight, I have one item for your consideration.
Portable classrooms are needed at May Creek Junior High, Morton Ranch Junior High, and
West Memorial Junior High.
These are being presented at the April board meeting due to a few late staffing additions.
Brown and Root Industrial Services has completed similar job type work in our district in the
past and is currently under contract for the portable connections that are taking place
this summer.
This project will be completed by July 31st of this year.

thank you any questions this we've we bought portables and we did them in the
budget for those portables these are the additional ones like mr. Fuchs just said
so if approved tonight we will be following up with the budget amendment
for was it five hundred hundred forty four thousand forty one thousand dollars
next month if approved mr. president I have some questions Thank You mr. Pete I
always ask about portables because I just see they're so expensive I know we
can't we can't control that but you know those those are this cost of the small
homes you know and it's a portable building so I understand they have a
long life expectancy and all that well actually could you say what the life
expectancy is of a portables just so the public can hear we we utilize the portables um for about
30 years i think we talked about a little bit before a couple months ago but uh we do get as
most as we can out of the portability and as you move them throughout the district they do age um
but we do get 30 years 30 years all right a lot of our portables and and also what is this owner's
contingency of $100,000. So that covers any unforeseen sites when we go to
particular sites and there's underground issues or items that we don't foresee
and drainage or any unforeseen issues that we need to take care of when we get
there that does contingency dollars covers that kind of things or if the
county comes back and says we need additional elevation certificates or
anything of that nature the contingencies if they're not used it
It goes back, but we have them there just in case we need them.

And then also, I just noticed, you know, I know that we just renovated Fielder Elementary,
but Fielder still has, I don't know, do you all know how many portables are at Fielder?

specifically put them tip them over to a mandatory title one campus and so they received some
late
staffing to account for that title one status and
Morton Ranch junior high is also close behind

When we say the total project cost is $544,000
and we've got an owner's contingency in there,
that owner's contingency on this one is probably a little high.
part of that and was something mr. Fuchs didn't mention is that is the traffic
studies a possibility if I had to do some traffic studies we do not feel the
need to go over five hundred forty four thousand dollars but obviously if we
needed to do something that exceeded any price tag that the board approved we
would take the necessary procedures to let you guys know trust you has nothing
to do with trust I trust all of that I just don't feel comfortable in leaving
it open-ended with my fiduciary responsibility.
So I would say we're not leaving it open-ended.
You have the information that's in front of you, so it's capped as is.
And if we need to bring an amendment to the project or if it's something that's outside of the
superintendent's scope of authority that is within CV policy,
CV local and legal policy, then it would come back to you.
I don't believe that we've experienced that, at least not in the six years that I've been here, that we've experienced that on portables.
It could, but again, it's specifically listed in the publicly available documents.
What is the superintendent's CV expenditures without board authority?
Well, it depends on the nature of the change order, and I can't offer that legal advice without actually seeing what the request is.
Hundreds of thousands of dollars.
Mr. Smith, do you have something to say?
I'll just say that this is a $500,000 hit that would hit his budget
and would hamstring him for the maintenance and operations stuff
that he's going to be trying to do between now and the start of school.
And so what we're doing through a budget amendment
is we're increasing his budget so he can take this on.
And in here, what is the contract amount is $421,000, and then the owner's contingency.
We feel that that's beneficial enough. If it was over that, there would be two things that would
be necessary. Either we would come back to the board for more money so we don't hamstring his
budget, or if it was over it, it probably wouldn't be over it by much, and his normal budget can
can probably absorb some expense.
$580,000, $40,000, it can't absorb.
But if it were to go over, and I'm going to guess it won't,
but if it were and it was $10,000 as an example,
his budget could absorb that, and it would be a legal expense
because it is in his budget.
But I think that the parameters that are outlined in here
will cover that amount.
And then the reason for the budget amendment is to make it to where, again,
we lift that overall budget to take this expense out without hamstringing him so
he can do things to get ready for next this finish out this contract a big
right it's not a budget amendment this is contract approval correct yes yes
this is the contract approval next month we'll follow it up with this amount that
in total in the budget amendment so to answer mrs. Fox's question is there any
disadvantage of putting a not to exceed limit on the motion of the value the
contract value of the 544-336 is there any disadvantage does that cause you
guys any operational issues with executing the project if we do that no
sir I I don't believe that it's necessary because the information is in
there but you get no disadvantage right to move on past this if we just put it
not to exceed contract value certainly I think that that's implied by the motion
but you can add the language okay mr. president yes I just want to make very
I trust our people very much. I come from a long history of how I've seen things before and as our fiduciary responsibility, I feel more comfortable seeing a number there, but I don't need to change this motion tonight. In the future, I would like to see that if possible, if anyone else agrees with it. But I'm not trying to show anyone disrespect. I was simply asking if that, because I'd seen it that way before.

I have two items for your consideration this evening, both relate to Smalls Elementary.
The first item is the approval of design associated with the renovations and building addition to Diane Windhorn.
with me this evening is principal Charlotte Gilder Katie I was project
manager Trey Barnett and Jennifer Wagner from HK architects I will now ask
principal Gilder to share some comments and then I'll turn it over to HK s good
evening president Schulte dr. Gorky and Board of Trustees I am super excited to
be here tonight this year Schmalz Elementary turned 20 years old so I'd
like to say good things come to those who wait we've been waiting for this new addition and
i've enjoyed working in partnership with trey and miss wagner um it's been a very good learning
experience for me thus far and i'm super excited about what is to come as we continue to create
unparalleled learning experiences for our baby sharks in the land of the sharks.
So this new addition is going to help us to be able to do just that,
but it's also going to help us to be able to live up to our school motto of being exemplary
and being the example for our district.
So I can't wait to see the finished product and what all is to come.

So we are very excited to be working with Schmalz and adding this addition.
We had a few goals for this project.
We wanted to minimize the portables on campus.
We want to increase the outdoor safe play space, and we want to rethink the interior
groupings of the classrooms to reinforce the different grades and communities that were
originally built into the school.

okay yes thank you so as the current schools laid out you can see that we
We have multiple portables that are taking up kind of that outdoor play space.
And the original configuration of the school was so that we had communities by grade.
And those have become a little bit dispersed as groupings have grown.

So that, oh.
So as we've looked at adding an addition, we're looking at adding on to the west, southwest
end of the building.
This allows us to add additional classrooms of six kindergarten and six pre-K classrooms.
It also allows us to reorganize the existing spaces into the groupings of classrooms so
that we can group by grade and they begin to incorporate the community pods that they
were originally intended to have this also will free up for outdoor space and allow that
playground space that principal gilder has been looking for so this is just a little bit close
up you can see we're going to add a little bit of extension of fire lane but use the existing
drop-off remain remaining that was done recently to keep the traffic in the same order we are
and just work on additional classroom space.
This is the existing structure as it is now.
This is the addition shown off to the south end of the building.
So incorporating similar architecture to what is there now,
a one-story space and opening up the back as we mentioned.
A brick structure to tie into the existing brick structure.
And this is what we have.
