On behalf of my colleagues, I welcome everyone to this evening's regular board meeting. Each board member received the agenda and documentation for this meeting Friday, February 22, 2019, and have had three days to study its contents and to receive clarification from Mr. Gorgorski. Additionally, the board met last week in a work-study meeting to receive information and recommendations from staff, administration, and the superintendent on these agenda items. Board members were able to ask questions and receive answers and should be prepared with responses and action tonight. The board has just reconvened from closed meeting in accordance with chapter 551 of the Texas government code any action arising from discussions In the closed meeting must be taken in an open meeting. We will now move to agenda item 3.1

Madam President, my suggestion was that we not do this tonight. We have an extensive agenda on a regular thing. We have observations. We're putting this at the front of the agenda. I think it takes 30 to 45 minutes to adequately get through this. I was there. I heard the nonsense. We had detailed reports. Are we really going to keep all these people 45 minutes waiting to see the nonsense? that we've listened to where we can answer questions. My suggestion is that we set this for a special meeting. If necessary, if we can invoke the provisions of emergency meetings, because I think now that this has been brought to the public, that there is more of a sense of urgency, and I believe that this should be a stand-alone item. them. Mr. Grigorski. Thank you, Madam President. So we've got a special guest with us tonight, and I'm going to go ahead and invite Audrey Aguirre from Bear Creek Elementary. She's a fifth grader. I'm going to invite her up to the podium, and she can come on up. She's sitting over there in the front row next to her principal, Dr. Lorena Zertucci, and her parents, Crystal and Abel Aguirre. And she has some siblings here, it looks like, Evelyn, who's in eighth grade, and Annabella and Abel that are in third grade. And a few things about Audrey that I'd like to share. She's got some special interests such as swimming, chess, painting, crafts, cooking, baking, and dogs. Favorite subjects are science and social studies and a quote from her teachers Emily Smith fifth grade teacher says Audrey is a joy to have in the classroom she is hard-working dependable helpful in kind Audrey sets a great example of these character traits for her classmates and from her principal Dr. Zertucci Audrey has been an excellent student council president she represents our Bear Creek Elementary student body well leading monthly meetings and spoke spoke beautifully at our 40th anniversary celebration. She is a hard worker whose leadership will take her far in life, not to mention that she is part of a lovely family with three more Cougar siblings. So welcome, Audrey. We'll turn it over to you for the pledge.

Bear Creek is a great school. We just celebrated our 40th birthday as the heart of the community. I love meeting new students as I change grade levels and I look forward to the first day of school. Each grade level is a new chapter of my life story and I know I'm going to learn new things. There are a lot of activities in each grade level. In In kindergarten, my favorite activity was our field trip to Dewberry Farms. In first grade, we got to see the baby chicks hatch in our open area. A funny memory from second grade was trying to get two slimy mealworms back into the box with my friends. In third grade, you can become a library helper and help our librarian, Ms. Baker. And in fourth grade, you can join Cougar Choir. Since it is my last year, I joined student council and I was elected president. I am in STEM as a science club for girls and still in Cougar Choir. I am also a fifth grade VIP, which stands for Very Important Privileges, to help us prepare for junior high. One of my favorite things we have is our monthly Cougar Pride celebration. A student from each grade level is chosen and recognized because they were a role model to others. The students go up on stage and have their poster read. And then we hang it up in the halls. Everyone gets to see and congratulate the students. I know I will enjoy the rest of my year at Bear Creek. Thank you and have a nice evening.

on this very day 100 years ago on february the 25th 1919 the katie independent school district was ratified by the legislature of the state of texas the state has recognized the efforts brought brought forth by the founding families of this community to establish a public education system that would provide basic reading, writing, and math skills to their children, helping those families further the Katy economy and their dreams. From those humble beginnings, Katy ISD has grown to become what is most certainly the best school district in Texas and also, some think of us as the best school district in the country. For over 100 years, the Katy ISD school community has experienced a number of successes as well as challenges, but this district has persevered time and time again. It has overcome both mother nature and human nature during these past 100 years. THROUGHOUT EVERY DECADE, THIS COMMUNITY, ALONG WITH EVERY TEACHER, PRINCIPAL, SUPPORT STAFF, AND TRUSTEE, HAVE WORKED TO MAKE DECISIONS THAT FURTHER THE EDUCATIONAL EXPERIENCE AND POSITIVELY IMPACT THE WELL-BEING OF WHAT IS NOW 80,500 STUDENTS. During this three-part competition, team members appraised components and parts of tractors and agricultural instruments. we did have a brief presentation this evening in closed session and to the extent that you have have moved to approve the release of the report. I have our outside counsel, Mr. Harry Jones here to present to this board of trustees. For just a little bit of background context with that, which I think is important. Probably for those in the room that are wondering what it is that we're discussing. In late January, there was some allegations made against our police department which, which if true equated to crimes against children, corruption and official oppression. What was specifically alleged was that police reports were being altered by our police department. And it was done so that our children, real children, would be sent to real jail time. When we get that sort of allegation with that sort of specificity, we take action. And so, in less than 24 hours, had a discussion with our chief executive of this district, decided to bring in outside counsel, Mr. Jones, and he's going to give you his report today. And I think what you'll hear from him was that his mandate was to go find it. If it exists, go find it so that we can report it appropriately. And with that said, I'm going to turn it over to Mr. Jones so that he can give you a brief summary. I'd encourage us to let him finish his summary, and then we will turn it to you for as many questions as you all need tonight.

I asked you in executive session two or three very basic questions. Could the district write you a million dollar check for you to tell us what we wanted to hear? No. Have you investigated other public institutions and told them what they did not want to hear?

Yes, and almost 100 investigations, I'm sure about half of those turn out exactly opposite to what the people wanted that asked me to come in.

So in terms of what the media is about to hear, what the people in this room are about to hear, and what the people on video and subsequent are about to hear is, if you found wrongdoing you would look us in the face tonight and you would tell us wrongdoing without hesitation or equivocation yes in fact if I found

wrongdoing I would have gone to the law to the authorities immediately and not waited for this night thank you go ahead mr. Jones good evening this this is a report on our investigation of allegations of corruption and official oppression in the KDISD Police Department. My name is Harry Jones. I'm here with Danielle Herring and we led the team in this investigation. First of all to describe what we were investigating, what I will call the Dolan claims. In the late evening of January 28th at almost midnight of this year, Sean Dolan posted claims which we'll call the Dolan claims that he had informed the KDISD Superintendent of Corruption occurring in the KDISD Police Department. The implication was that the district did not pay attention to those allegations but in actuality we have found that the district's chief executive did speak directly with Mr. Dolan and in fact did so at the January board meeting and while the superintendent declined to use Mr. Dolan as some sort of go-between he did offer to speak with whoever was complaining of corruption. Mr. Dolan refused that information. Nevertheless, the superintendent was always willing to to meet with Sean Dolan about these claims. Thereafter, Mr. Dolan posted publicly that an allegation was reported to him by a former police administrator, and that's verbatim. The only particulars Mr. Dolan gave were police statements from students are being changed, are being changed, present tense, by KDISD police to protect the district. These statements are later used in real courts to sentence real students to real jails. Mr. Dolan claimed many officers have left the force due to lack of integrity and he wrote that these officers are willing to go on the record but he advised them not to. Parallel to this there was a request which we'll call the PIR request for five case files from Katy ISD Police Department including case number, crime date, under the the Request for Public Information Act. As required by law, those have been referred to the Texas Attorney General for determination. Within 48 hours of those Dolan claims being made in the post on January 28, KDISD acting through General Counsel and Superintendent asked me to conduct an investigation into those Dolan claims. And let me be clear, the direction I was given was that if a crime as alleged in the Dolan claims appeared to have been committed we were to report it without even waiting for the district's approval. That was also my command and directive to my team. Potential crimes because if the Dolan claims proved true those were crimes included suborning perjury, official oppression, witness tampering, and possible federal civil rights violations and fraud. So we knew we were dealing with very serious claims claims of great gravity. The reason for the administration's approach was if those crimes were being committed by KDIC police officers against children, the need to determine who was doing that, how they were doing that, who was aiding or abetting them, and which children had been wrongfully convicted or affected was absolutely critical, and I agreed with that formulation. Since it was not clear to us that Mr. Dolan was going to provide any more assistance based on the refusal to give the superintendent information, the district told me to take a broad approach, to go wide and deep, because the philosophy was we really do need to know. Why bring in someone like me from outside the district? Well, besides the difficulty of a school district investigating a police department, which is almost so obvious that it's hard to say, the competing narratives of always of witch hunt versus whitewash are as old as every investigation that was ever conducted. Since I've done almost a hundred of these usually under the white hot glare of media coverage someone's gonna say whitewash and someone's gonna say witch hunt. It's not novel and it's not even that interesting. The key is to avoid that excuse. Too many people know each other inside a school district and a police force. Conclusions are distrusted. A fresh set of eyes is always better. I had no dog in the hunt. I was prepared for any set of facts to appear and choosing an outside investigation group was needed because it's very difficult to investigate yourself. Also the scale of what we were looking at necessitated a firm like mine which has appropriate resources. Our firm is the largest employment law firm in the world. We lead the nation in the workplace investigations. There are very few attorneys in Texas or the whole country who have led more public institution investigations I have covering everything cash management human trafficking vendor fraud athlete safety online building whatever you want to talk about we've done it we did not know going in how complex it would be or if it would garner significant media or involve a referral to the FBI to Texas Rangers or any federal authorities and that is my specialty is having handling investigations where you really don't know where it will go. So independence which Mr. Scott alluded to our recommendations are not uniform in my investigations my findings stay independent I will not work for any institution who tells me who I can talk to and who I cannot talk to I just will not do it. We will not allow an institution to steer our investigations investigations. Nobody in the administration, nobody told us who we could talk to or not talk to. No one told us that there were subjects forbidden or problems that were excluded from our review. Our findings and conclusions are only as valuable as our autonomy. Thus, if you look at the investigations that we have led and I've led personally, you'll see a full range of outcomes, full clearances, full exonerations, all the way down to actual terminations and self-reporting to criminal authorities. We conduct our investigation with an open mind. So back to the Dolan claims. What were we trying to find? We sought to find the truth about the Dolan claims through a prompt and thorough investigation. That's what's required. required. The Dolan claims did give us some clues and so we were grateful for that. A former police administrator, so who is he or she, five files were requested in the PRR request, so which file was dirty, who was alleged to be corrupt, and one way of corrupting the file, it was alleged, was to alter a student statement, which then finally had the effect of sending someone to jail to protect the district. So what we tried to do when we looked at those clues was not just to find those exact problems, but we said let's make sure we find any irregularity and dig deep for any inconsistency, no matter how minor, because we had to confront witnesses with facts and then maybe that would lead back to the corruption. That's the likeliest way to find corruption always. We surprised people. We didn't keep people warning. We were not shielded, we were not directed, and so we were likely to find someone who would know something, even if Mr. Dolan wouldn't give us more specificity. Also, we followed inferences from the Dolan claims and tried to make sense of those. But we were directed to find any wrongdoing. I will say the summary after all this and I'll go through the methodology in a minute but the summary of the conclusions that we have after our prompt and thorough and good faith investigation after interviewing and talking to over 50 people and reviewing thousands of documents and inspecting dozens of sites and reinvestigating very thoroughly the five files that Mr. Dolan identified in the Dolan claims and then going far beyond the Dolan claims because we talked to people who had left the department, even people who might be disgruntled for some reason or another, to try to find any abuse of power, any abuse of process, or even simple violations of department rules. We can certify, and I do certify tonight, the Dolan claims are not supported by the facts, they are not corroborated by any witness, they are not suggested at all by by the circumstances and they are devoid of proof. If someone brings forward some sort of proof or document or person that we haven't talked to, I'm open to that still, but I'm telling you that right now there is no incriminating statement that was found to be altered for the purpose of convicting a student falsely and all five files identified in the PR request are actually solid examples of good policing. policing. Any department scrutinized by a team such as mine will have areas for improvement and any such findings were minor and involved mundane processes, none of which involved fraud or corruption or witness tampering or perjury or dishonesty. We also found, and this is crucial for everyone to know, that this very department has a strong record for for self-policing. For example, an episode in 2003 wherein an officer altered dates on documents to hide a mistake she had made. The District Attorney's Office was informed of this investigation and findings and the department went to the Harris County DA's Public Integrity Division, presented it, turned it over. That officer was indicted by a grand jury for tampering with evidence and terminated from KDISD. This shows a strong commitment lawfulness a trait that has remained. That is not to say that it could have changed, that it might not have changed, but during the course of our investigation we found that all the current officers actually know of that 2003 case and it enforces a zero tolerance attitude towards altering documents. There is no incentive that we could find to alter documents or statements or files. There is no financial incentive to close cases. There's no financial incentive to close more cases. There is much more incentive not to because as they've learned in 2003 someone could actually be indicted by a grand jury. In fact I will go a little further than that. This police department has a tendency towards great adherence to detail. Even the even the statements we did look at had great grammar, they were corrected, they were observed, they were double-checked, and there was a lot of different backstops that would catch anything that would be wrong in those statements. I will say that I could honestly profess the KDIC could be proud of its police department, its leaders, and its rank and file. The district is less well served by having someone like me who's quite expensive investigate claims like the Dolan claims which wasted the taxpayer monies which Mr. Dolan could have saved but chose not to and I'm going to ask you a question and I would invite anyone to answer it in their head why would a sincerely concerned citizen withhold crucial information about crimes against children that if shared would abbreviate the investigation that was launched into the TIP and why would a truly well-meaning complainant prevent an investigator from knowing which students to protect? The answer is he wouldn't. Not if he was sincere and not if he was operating in good faith. Since it was unclear from the Dolan claims who corrupted which files for what motive affecting which students and where the report originated from we wanted to hear more from Mr. Dolan. So on February the 1st right after I took this investigation on and wanting to avoid any kind of gamesmanship about what I did and what I didn't know I went straight to meet the Dolan's at a local eatery called Snappies. We shook hands I introduced myself and handed Mr. Dolan my business card. I asked politely if I could sit down with him. Mr. Dolan urged me to sit. I told him what I've been asked to do, exactly what I've been asked to do. I ordered a coffee, the restaurant was packed, even though Mr. Boland was made aware of the cost and scale triggered by these claims and even though it was clear that it was, if the motivation was to protect kids from being falsely convicted, he refused to give me more information. Mr. Boland, Mr. Mr. Dolan admitted to me that there were not five corrupt files, that the PIR request for five files was specifically designed so that four of them were false, they were clean files that he knew they were, but to confuse KDISD and not let the district know which one was real, who was dirty, and what dirty cop was operating inside the district. I urged him to identify which file was the corrupt one because my hourly rate is quite high. In fact, I told him exactly what it might cost if he didn't give me a target. We were always going to do it anyway, but it would save the district a lot of money. It also would help us get the right answer. So for two reasons, someone motivated in good faith would have told me. I told him don't withhold information because if you want someone not to be convicted falsely tomorrow by a dirty cop, the best way for you to help me stop that happen was to tell me. If you don't, it'll be hard for me to stop. Mr. Dolan promised to call me back in an hour and try to give me helpful information from a witness that he claimed was reluctant. He never called me back and even though I emailed him several times, probably more than five times, seeking clarification, I never got that help. Instead, Mr. Dolan went to the district to verify that I was in fact authorized. When he was told that he was that he I was authorized then I continued to ask him for help. We were gonna go ahead anyway. The superintendent was adamant that he wanted to find any corruption that existed in the police department and so we went after it. I was to interview as many officers and ex officers as possible to satisfy due diligence. But my emails did get very very specific from February 1 until we started interviews. Sean, I was setting up next week's schedule of interrogations. You can help me streamline my process by calling me with any helpful information. And I gave him every single way to contact me, including my mobile phone. Again, to give you my timeline, Sean, my team will start the interviews this coming Wednesday and Thursday. To handle the scope, we may have to use up to four lawyers. This will help you see the upside to targeting our anti-corruption efforts. There's no way around it. It's time consuming and costly. Thanks for any help you can give. Mr. Dolan then told me that he's been busy and forgotten what I wanted. And so could I say it again? So I did. And I told him, once I start on something like this, it's better not to let a district or department have any ability to steer or shift my path and find the truth. I run my own investigations. I won't accept any job if I don't have operational autonomy. My understanding from our chat at Snappies today is, and then I gave him a list of six. You know of a person who knows of a practice or an incidence of student statements being altered to make convictions easier. Mr. Dolan hatched a new excuse not to give me information. He said, my concern is if I identify the dirty file, the district would then be able to clean it up and cover their tracks. I solved that issue immediately. Sean, I'll maintain any static copies. Nobody can destroy mine nor can they direct me to do so. That's part of my investigation. All I can ask you to do is identify the dirty cops, the dirty files, and I will do my job. My job is made harder by someone who withholds information in this case. This went on and on. I actually wrote a long email which detailed almost everything that I was doing in the investigation gave him a framework of it and asked one more time for some kind of hint and thanked him for any assistance at that point Mr. Dolan stopped communicating with me and tried to contact the police chief before I'd even started doing my interviews I wasn't sure of the reason for that but let me be clear about something this investigation was never of Mr. Dolan It's not ever going to be of Mr. Dolan. The investigation was of the Dolan claims. But by necessity, I started with the person who made the claims because that makes sense. The only person in this entire saga who tried to stop or harm the very investigation, which necessarily harms the potential of kids being hurt, was Mr. Dolan. Everyone else, even people who have left here, third parties, have cooperated fully without any need to repeat the invitation. We didn't have the power of subpoena. We didn't have any kind of power of oath so we had to ask but everyone else cooperated. We interviewed over 50 people. We reviewed personnel files and ran searches and background. We reviewed social media. We scoured the records of all current officers. We built a framework that works which is to actually build a circle around it and then walk it slowly in with interviews that look for internal and external inconsistencies. We heard typical complaints about politics and work and so forth but no one was corroborating any kind of corruption. Furthermore we were actually seeing a pretty tightly run department that had lots of double checks. We pushed hard to see if this is a scrupulous force that actually is dedicated to integrity which is on their logos and maybe find anyone struggling with needs for money or or someone struggling with addiction. We spoke to departed officers, some of whom were not exactly happy with their former employer, as is the case sometimes when you find ex-employees. Those people were not shy about telling us things they didn't like about a person, personality-wise, but when we pushed, and we pushed hard to say, was there someone, not only who did something wrong, but would they do something wrong, No one would say that someone would alter a statement. No corruption was identified by any of them. In fact, some of the criticisms were actually, you would call them compliments, that it was tough. The department's tough on people. They want to make people do the right thing. We could look at computer programs. We could look at documents. I wanted to have someone show me exactly where evidence starts and where it goes, spot checks, show me a document and how you alter it? How do you modify a document? How can I see every single time a document was changed if it's in a police case file and tell me how I could find who did it? Who has authority? These witnesses I was talking to were not prepped at all. They didn't even know in some cases who I was before I walked in just like Mr. Dolan and sometimes they were perplexed or even alarmed. So we had good valid feedback to gauge whether this department could hold up under interrogation. We never got any of us any inkling that the investigation was being undermined or diverted by anyone except Mr. Dolan. Our team reviewed all relevant statutes, regs, laws, cases as well as significant policies, memos and discipline documents. What are people punished for doing? What are people rewarded for doing? None of those things lined up with the desire or incentive to alter statements. The police officers are not paid anymore, reward anymore or in any way elevated because of closing cases faster or convicting students quicker. That just doesn't exist. We also looked at these five case files so beyond looking at all the people and making that be bigger than the Dolan claims actually, we actually assessed the five case files that he had requested. The first file had to do with a custodian losing her master keys. We investigated that. We reinvestigated these cases but that just doesn't even fit anything remotely close to the Dolan claims. Nevertheless we reviewed it. We interviewed the reviewing officer because he wanted to know what kind of things could be found in an inoculated case that would help us in the other more suspicious ones. The second case we excluded from a complete reinvestigation was a case of burgled cars in a parking lot. It closed because it was not sufficient evidence to pursue this matter and no students were even involved in that matter at all. The third case was someone who was actually making some paraphernalia for drugs. This did not feature any statements at all. The evidence was found on the student's person and the only penalty was suspension. However, we did interview the officer in this case and then we were left with two cases that might could possibly fit the Dolan claims if we were liberal. So we interviewed, so we did the methodology of walking through each one of these cases from the beginning and then from the end and then back to find any flaw or problem. Then we tried to find any illogic for those errors, any kind of corruption conditions and space and time for people to do things that were wrong. The first one had to do with a drug bust and it's a righteous bust. It was actually caught by another student. That student owns up to every single part of her statement. I walked her through every single line, every single word. It was her own handwriting. That was the incriminating statement. The administrative search was done properly. The evidence has been properly handled. If you track that that from school all the way to Fort Bend Juvenile Detention Center to DA to the family of the boy that was actually arrested. You don't find anything that leaps out at you. What you do find actually is some very good police work. People doing the right thing and trying to do the right thing. You have a great quartermaster who is praised by all officers and departed officers for honesty and skill. She's the person who actually maintains evidence. She's trusted and she could explain exactly what she does with all the evidence. She even does extra things above and beyond. She has her own special spreadsheet that is not even called for under the policies. She does it because it triples my workload but it's better to have it a lot of ways. I think that's great. So the evidence found its way to the proper person, it's weighed correctly and the arrest was done properly. There was also a case about a fight and we thought well maybe this checks some box. Now to be fair the fight case doesn't even result in anyone going to jail so it's difficult to to imagine that fitting the real jail part but we did look at that as much as we could every different way at every different angle and what we found there was just a very difficult dilemma. Yes sometimes parents don't agree with how charges come down or who gets faulted for a fight and it was a tough call but we We looked at every single bit of video evidence and so forth and couldn't find any incompetence, let alone corruption. So while reasonable minds could differ about the eventual punishment, the choices were made well within standards. I will reiterate, in the given time that we had, which was extremely prompt and urgent and thorough, I found nothing to corroborate the Dolan claims. claims. We went as far as we could have gone actually just given the Dolan claims. We took the opportunity and were asked by Superintendent and General Counsel to find anything that would have violated district standards, not just criminal legal standards. I appreciate the opportunity to have served on the Texas Association of School Boards on behalf of the district for the last couple of years. I think I'm going to miss that as much as I miss being here. As an adjunct to that and as part of that service on TASB, I've made a very special effort to reach out to minority members of the board of TASB and to minority members of course of the Mexican American School Board Association. The state of Texas has spent 30 years lying about academic equity gaps, not telling the truth about our responsibility to at-risk minority kids. I have visited with dozens and dozens of members of TASB and MOSBA and it's a It's a great honor that they've asked me to present a major presentation at their national convention later this week, and I look forward to doing that. The topic will be on equity, touching on school finance, and I just want to say to KTISD, I very much appreciate the opportunity to have been in this role. I've tried to serve you with respect and dignity up there. there are a tremendous number of people who understand the challenges that are confronting public education beyond the public relations, beyond the glitz, and this opportunity to speak at their national convention is a great honor, and I'll try not to waste it.
