Move to agenda item 3, 3.1 consider board approval of a resolution and order of the Katy Independent School District authorizing the reappraisal of property within Katy ISD for Ben Harris and Waller counties damaged by Hurricane Harvey and the flooding caused by the
storm. Dr. Head? Yes, I'm going to go ahead and give you guys some information on section 23.02 of the Texas Tax Code which provides that the governing body of a taxing entity that is located partly or entirely inside an area declared to be a disaster area by the governor may authorize reappraisal of all property damaged in the disaster at its market value immediately after the disaster. As you know, Waller, Harris and Fort Bend counties were declared disaster areas. Also part of section 23.02 Texas tax code further provides that a taxing unit that authorizes such a reappraisal must reimburse the appraisal district for all the costs of making the reappraisal and that such costs may be shared by each taxing unit providing for reappraisal in the same territory. The costs associated with reappraisals for damaged properties shall be the responsibility of the requesting taxing tax units and shall be prorated to all such entities and we're looking at the properties again in Fort Ben Harris and lower counties that sustained damage from Hurricane Harvey and flooding caused by the storm. Each appraiser, chief appraiser of each county has the authority to determine what it is that they want to appraise and I know you guys received all of the information on the resolution but section nine is an area that we as a district wanted to make sure that we placed into this fort ben county and waller county have already indicated that they are going to reappraise the properties that were damaged and requested by the owners whether it's a business or a homeowner harris county has not confirmed one way or another how they want to do it. Chris, Justin and I, I'm sorry, Mr. Smith, Mr. Graham and I have had several conversations. We've been on conference calls with multiple entities, most recently with Harris County yesterday, who had their attorney as well. They have not committed one way or another, but because of that lack of a commitment, we wrote into Section 9 of this resolution, which we are seeking the board's approval, that the KDISD Board of Trustees is only authorizing the appraisal districts in each county to conduct a reappraisal under Section 23.03 of the Texas Tax Code if the reappraisal is done on a per-parcel basis with the consent of the owner of the property which was damaged by Hurricane Harvey and flooding caused by the storm. Should the chief appraiser of any individual county intend to reappraise property which has not been damaged or intend to reappraise damaged properties without the consent of the owner, this authorization of reappraisal shall be null and void for that individual county. As a school district, we want to provide those individuals, those businesses, those homeowners that had properties damaged by the storm to have the choice doesn't mean they will some may some may not but have the choice to seek a reappraisal of their damaged properties seeking at we're in a school that's the school bill everybody's gonna run now but we would like to provide that choice to the homeowner we'd like to provide that choice to the business owner in light of of the situation they've been through. We're estimating, and I know Chris and I, looking at the total number of parcels, I sent you guys some information. We've looked at some information. We're estimating that this could possibly cost the school district from $1.5 million to $3.5 million. We believe, again, an estimate, ballpark range. But we also know this, that there is some language in Texas Education Code and law that the Commissioner of Education is then responsible for making the school districts whole, not on 100% of our taxable value, but on about 66% of it they would make us whole on. If there's any further questions, I've got my two geniuses sitting right there that can provide additional information. Again, it's the district's recommendation that the school board consider this.
Madam President. Ms. Fox. Dr. Hintz, in your estimation of the cost that could come to the school district, does that take into account the energy corridor there and some of those very large businesses that were damaged? It wasn't their entire building.
It does. We've looked at a satellite map of that area. We've looked at some scatterplot maps of that area. and it does take into consideration that area. I'll tell you what, we really don't have a clue what this is going to cost us until we know who takes advantage of it and what their taxing entity is, a $100,000 home versus a $500,000 home. But we have looked at that energy corridor. Matter of fact, I think we've got some maps here. depending on the map that you look at, we don't believe the energy corridor was as near as damaged as we originally thought. Chris is going to provide you guys. We had Jim Farren, our person, provide a map, and then we also received information. There you go.

This is a map that Mr. Farren. What you're looking at is a map that Mr. Farron from our GIS department put together, and it's based on a NOAA satellite view on August the 30th. So basically what he was able to do is to fly over parts of the district that we and it was able to look in in people's yards based on the imagery or on their property based on the imagery and do his best guess and roping in those properties and then he took information from both the Fort Bend County and Harris County databases and tied all that together to give up give us an estimate of some numbers. Now I don't think all the areas were on there that for example there's a a grosky road over near tompkins high school that has flooded on multiple occasions i don't see that on the map and then unfortunately the noaa website did not include katie proper or that that imagery did not include katie proper in some of the northwest side of our district so it's just an estimate but that is the imagery that he used to rope in property values to properties and subsequent property values of said properties
Mr. Lacey. Mr. Smith, off the top of your head, do you happen to know, does this include personal property that's on the tax rolls that we obtain income from as well as real property?
It does not. It's just, actually it does. It includes the taxable value. It includes the taxable value. It just has the market value and the taxable value is the only information he was able to delineate down to the website. site. So if on the businesses, for example, it should include property values, personal property
in that as well. Okay. And then also, Dr. Hintz and Mr. Landers and Mr. Smith, all this Mr. Smith is really confusing me. I'm sorry. Lance, Justin, and Chris. Thank you. That's a lot easier for me to remember. But how will we be, not just presenting this to the public, how will we, what will be the procedure? Will they go through KDISD or will they go through the Harris County
appraisal. It would then be the chief appraiser that is responsible for notifying and seeking whether there's interest or not in that. Once we pass the resolution we pass it off to the chief appraisers of all three counties. And then lastly if you don't mind. But let me add this. We will communicate though out to our community that we have the Board of Trustees has whether you know one way another that if the board so chooses to approve this resolution we're prepared to release a statement and prepared to release release information to our community about the option that was you just answered the question I was about it's because we're great minds think a lot yeah one last thing if you don't
mind just one thought and I'd like to put this on public I think this is the right thing to do for our community this is there's a lot of people that have have gone through. Mrs Fox is one and a lot of other people have gone through so many things that are just devastating that those of us that did not go through it just cannot start to fathom and our hearts and our prayers go out to all those that have been affected. But this is I think this is just the right thing to do for our constituents for our people that are within our our bounce.
Madam President, so I was going to say exactly the same thing. Um, my my My neighborhood was affected and a big portion, right? I live near Canyon Gate. I live in the Cinco Ranch area near Beck and Creech. And my neighbors and friends are asking, you know, is the district going to consider this? And I told a few of them that it was on an agenda for today. And it's like the response is that makes me want to cry because you're the entity who is showing that you really care about families. because no one else is doing anything to help FEMA is not showing up the way they should the you know I know that all of the government entities run slowly I I get that but they keep getting no's and no's and they're getting they just feel like they're getting help from nowhere and so this whatever help comes from this for them is the right thing to do for families who have contributed over over and over and over to contribute to our district, to invest in the schools and the children and the teachers of this community. They've been here investing for years, as have the main creeks in Morton Ranch and the Wolf areas and the Fleetwood areas. They've been investing in our community for years and years and years. And for us to do what's right for them is a way to say to them, we hear you, we see you, we love you, we care about you, and we will do what is right, even at a cost to us and we'll still instruct children and we'll still take care of our teachers and our staff we'll find a way to do it and we have continued throughout this process to keep families and children and our employees at the forefront of our decisions and I am very proud to be a part of this leadership to do that thank you dr. Hemp for your leadership and
and everybody here. I appreciate you. Madam President, thank you for those words, Ms. Fox, and I understand what you've been experiencing since Harvey. As many of our community is, I've been in these shoes back in 2005 when we lived in Louisiana and we lost our home to Hurricane Rita, so I do empathize with our community greatly in what they're experiencing with government entities and insurance companies and how long all of it can take. I would like to point out with this resolution, Dr. Hint, we're not advising our community one way or the other on what they should do. We're just simply giving them the option if they so choose. Absolutely. And I want to make sure that we put that on record that we're not taking a stand one way or the other on putting ourselves in a position on this is what you should do or should not do versus we're just opening the door on what is best for you as an individual for your
home absolutely with the appraisal without the resolution we would be then absolutely give them no choice also I think it's important to note and I'm glad you brought that up because it made me think this reappraisal is not for a whole annual year it's only from the time of the incident until the end of the taxing year all right how the chief appraisers are going to do it I'll tell you if they had Chris Smith working for him he already figured it out I don't give them any ideas. No. Actually we, no, no, not him. He can't, but we would like to give them some ideas of how to do this if they so choose.
Right. Well with that being said, Madam President can we move forward with the motion? Yes, Mrs. Dorff. Mr. President, very quickly, I think this is part of helping put the community back together. I think that the work that Mr. Smith and Mr. Graham and Dr. Hinn have done in getting us to the point where we can proceed on this, it's not as simple as you think, and I think the work there has been extraordinary. And this is a deserved, unanimous vote. this needs to happen because it is like Bill and Rebecca and Courtney have said it's the right thing to do. They've been there for the district in the great times and we need to be there for those people that have suffered enormously in
the bad times. Now my CFO said please make sure you reiterate the cost possibility to the district. 1.5 to 3.5 or do you want to stretch it to 4? but that's an estimate. It is a net current estimate but you guys know when we're working with Port Bend County, Harris County, Waller County, we've had good conversations with two, we've had head-butting with one and I'll leave that
up to y'all's. But it's the right thing to do and if it costs more money then
that's what we do because it is the right thing to do. Absolutely. Madam President, I would like to echo what Mrs. Doyle said. This is absolutely not us telling anyone what's right for them because there is as I've thought about this for many days now retired people have their taxes frozen not this is not the right choice for everyone this gives opportunity this is us saying as I say all the time as a school board we work for our community that they put us here and we represent your values and we believe this is a great decision to give the homeowners choice but please do your homework please talk to trusted people and figure out what's the best thing for them to do because it it is not the right decision for every single person but they will be able to figure that out on their own and them having the choice is the right
thing for us to do thank you dr. hint for all of your information and and this This map is pretty powerful too. Thank you for supplying that to us, Mr. Smith. And I would like to say that I agree with all the sentiments of my fellow board members. Thank you for your important questions and your heartfelt, obviously very informed words. These past few weeks as a school board has really taught us all, I think, a lot as trustees and I think we're all very very proud to be part of this district.
