Katy Independent School District to order. Today is Thursday June 4th and the
time is 622. Mr. Frady, will you verify that we're in compliance with the
provisions of the Texas Open Meeting Law in regard to the notice of this meeting?
Mr. President, we are in compliance. First item is talk about board waiver
Item 3.1
addressed the missed student structural day of flooding on May 26th. Ms. Bonney-Holland
will talk about that for us. Good evening Mr. President, members of the board, Mr.
Fraley. As you all know on May the 26th we had some rather significant flooding
in the Houston area and we were unable to attend school. In fact much of the
Houston area was declared as a disaster area. As a result, the Commissioner of
Education has urged and encouraged campuses and districts to apply for an
instructional day waiver so that we are not required to make up that
instructional day. As is required in statute, we did send out an electronic
notification to all of our Katy Improvement Council members and ask if
anyone objected to us bringing this waiver to the board for your
consideration to please notify us immediately and I'm happy to report we
had no response. So I think everyone this is one thing we can bring to you and say
a large group of people have agreed so we are happy to present this to you but
we would very much like to request this waiver from the state if the board
approves. President I will tell you that based on my Twitter response,
unanimous support for this waiver or students and staff yes mr. president yes mr. Mahowski

Mr. President, the next item is the resolution addressing the missed instructional student
instructional day and employee work day due to area flooding.

I want to say, Mihalski, I'm so sorry.
Griffin, Board Members and Superintendent Fraley,
secondary to the waiver, I am here to seek your approval
of the resolution that stands before you to compensate all employees
for not being able to report to work on May 26th.
Mr. President.

I move that the Board of Trustees approves the resolution
addressing the missed instruction student instructional day and employee
work day on May 26 2015 due to area flooding which resulted in hazardous
conditions including a declared state of disaster in Harris County I have a
motion by Rebecca Fox seconded by Henry deBrell that the Board of Trustees
approves resolution addressing the missed student instructional day and
employee workday on May 26 2015 due to area flooding which resulted in
hazardous conditions including a declared state of emergency state of
disaster in Harris County we have any discussion when I finish with the vote
then I'll read the resolution in discussion no further discussion y'all

Katy Independent School District Board of Trustees, June 4th, 2015.
Whereas the recent flood emergency in Harris County and the Fort Bend County
resulted in the closure of all schools and facilities in the Katy Independent School
District KDISD on May 26 2015 for the safety of students staff and the public
and whereas there was a recommendation to curtail travel to the public roads
throughout the Houston metropolitan area including all of KDISD and whereas
KDISD closed its schools and facilities because it must act in the best interest
of and for the safety of its students and staff and whereas the circumstances
circumstances completely beyond the control, district employees were forced to miss work in KDISD,
and whereas to financially penalize employees who are acting in the interest of public safety
will potentially be harmful in the future if these employees fail to act in a safe and prudent manner
during a natural disaster for fear of financial loss,
and whereas it will be detrimental to the best interest of the district to act in a way that may lead to
unsafe conduct by its employees in a future natural disaster, and whereas there is a public
purpose served and a benefit to the district to encourage prudent and safe behavior in
a natural disaster so all employees have the best opportunity of protecting their safety
and being able to resume their duties, and whereas there is a public purpose served and
a benefit to Katy ISD to demonstrate support of its employees, enhance employees' morale,
and support the retention of employees and whereas the KD ISD 2014-2015 school
calendar and related work schedules have been affected by these events and
whereas the Board of Trustees board believes it is in the best interest of
the KD ISD for the remainder of the 2014-2015 school calendar to remain in
effect as originally adopted and whereas the board has determined that none of
the days missed due to school closure during this natural disaster will be
made up by the KD ISD employees and whereas the board believes that a public
purpose exists or forgiving or excusing the absences of these employees due to
this natural disaster and whereas this resolution is not meant to excuse the
failure to report to duty on these days by an employee who are instructed by the
administration to do so or who were required to contact or job description
to report for duty and who are emergency services personnel or whose presence is
necessary to provide for the safety and well-being of the general public now
therefore be it resolved by the board that all the above reference photographs
I'm sorry all the above reference paragraphs are incorporated into and
made it part of this resolution and the board finds that a public purpose and a
benefit the KD ISD exists to excuse and or forgive the absence by district
employees due to school closure during the recent flood emergency and that
payment for such a day is necessary to conduct of the school public schools as
provided by Texas Education Code 45.105 subsection C and the
board hereby authorizes the superintendent of schools to excuse the
day of absence of district employees for school closure necessitated by the
the flood emergency and pay all employees full compensation for this day.
